This special pre-Conference workshop, the first in a planned series, is an in-depth look at issues faced by RRG directors and officers and RRG management in regards to Directors and Officers Liability. Experts will also guide participants through real world claims scenarios and issues concerning professional liability exposures to insurance company operations. Additional topics for future seminars may include Administration/Operations; Accounting; Underwriting; and Reinsurance. The session format is an open forum and is open to all Conference attendees.

State of the Market

This panel will explore the current state of the alternative risk transfer market. The panel will explore the effect of the softening insurance market on the formation of new risk retention groups and the possible winding down of current groups due to soft market conditions. Panelists will also discuss the potential impact on reinsurance for risk retention groups in the event that the amendments to the LRRA are passed.

State of the States: Issues Roundup

This session will cover issues of domiciliary and non-domiciliary state regulation. Panelists, including regulators from many of the most active RRG domiciles, will cover state-specific issues that our industry has faced over the last year, including state-specific reporting; the types of liability certain states consider covered under the purview of the LRRA; registration/regulatory fees and requirements; financial responsibility laws used to exclude RRGs from writing in the state; impermissible imposition of guaranty fund obligations; and legislative activities impacting risk retention and purchasing groups. All Conference attendees are invited and encouraged to join us as in this interactive session, as we brainstorm how we as members and as an Association can address all of the issues facing RRGs and PGs, now and in the future. We need your input on how NRRA should move forward as an Association, to best suit the needs of our members. We will also look back over the past year to recognize what NRRA has accomplished for our constituents. This will include a report from NRRA’s General Counsel on the Association’s vital legal and regulatory activities. We will also recognize those who have volunteered their time and talents over the past year to ensure that NRRA is advancing the interests of RRGs and PGs.

Professional Liability Policy, Coverage and Claims Issues

Speakers: Myra Barsoum Stockett, Joe Deems, Cliff Masch, Julie Robertson

This session will focus on professional liability policy, coverage, and claims issues specific to RRGs. The panelists will look at policy drafting issues that arise when RRGs are not governed by any state insurance law and when RRGs are doing business in multiple states. They will discuss how coverage disputes are resolved; what law applies to the adjudication of that dispute; and if outside counsel is adequately knowledgeable about the specific issues of defending insurance companies in coverage disputes when the insurer is and RRG.
