In competitive market, insurers exempted from rate/form filing requirements for policies purchased by ECPs or government entity insureds. ECP:

--must use services of agent/broker or employed, full-time RM

--must meet following criteria:

* net worth of $25M

* net revenue of $50M

* employs more than 100 employees/ company or 200 employees/holding company

* aggregate premiums of $500K

OR

--municipality w/population of more than 50K

--not-for-profit/public entity w/annual budget or assets of more than $25M

Gov’t Entity Insured:

--must be located in city/county w/population of more than 50K

--must use employed/retained RM

--aggregate premiums of $100K excluding life, health, medical or annuity

--must have more than 50 employees

Includes disclaimer by insured

Excludes workers compensation

ECPs must re-apply to insurance commissioner for exempt status every three years.
